Sunday, April 14, 2019 ((rezonodwes.com)) – Often one tends to define the State following a purely juridical logic by conferring upon it a moral personality and an institutional character while royally forgetting that this essentially philosophical notion can only be understood in the certain real 1 as a socio-psychological phenomenon.
In the course of its evolution, the notion of the state has undergone different forms of conceptualization. Machiavelli sees it as an art “the art of the state” and as an end. For him, the State is endowed with reason “the reason of State” which subjects it to an imperative of social justice. He imposes the law. Hobbes sees it in terms of absolute power “Leviathan”. The state of Hobbes no longer appears, as in Aristotle, who saw it as an extension of human nature, but as an artificial and rational construction of men. The essence of power (of the state) is to be absolute and Hobbes sees it as a rational construction 2 .
Hegel, for its part, gives birth to the struggle of men for the recognition. In the principles of the philosophy of law, he argues for an organic rational state that rests on law and values. As an organic rational entity, Hegel tells us that the state can not admit the separation of powers 3 . He therefore opposes Montesquieu who advocates the separation of the three powers that found the state “It is necessary that the power stops the power …”. Rousseau (1762) from his point of view regards the state as a social contract, Carey (1861) makes it result from an association of brigands 4 ; Plato, Marx and the Marxists granted him omnipotence, recognizing in him the absolute autocrat ordering all the political, economic and even sexual (Plato) relations of the citizens, while liberalism 5 confined it to the helpless state-guardian of peace and anarchism demands its definitive suppression. Finally, no philosophical, legal, economic conception of the State is therefore satisfactory. Why ? because none of them has been conceived from the sociological point of view, says Frantz Oppenheimer (1913) 6 a great German sociologist. The state, a historically universal object, can be understood in its essence only by a thoughtful study embracing the broad outline of universal history.
Thus, Oppenheimer tells us that only sociological theory has
hitherto embarked on this path, the great path of science: all
others have formed as class theories. Every state has been and is a state
of classes and any political theory has been and is a class theory. And
a class theory is not the product of reason that scrutinizes but that
of the will that covets and commands (…). From there, the understanding of the state
allows us to realize the nature of political theories
but the knowledge of these theories can in no way enlighten us on the
nature of the state.
The state is not
this end that Machiavelli advocates, nor this Hobbesian Leviathan, nor this entity
rational organic Hegel, this social contract at Rousseau etc. It is
as to its origin, and almost entirely as to its nature during the
first stages of its existence, a social organization imposed by a
winning group to a defeated group, an organization whose sole purpose is to
regulate the domination of the former over the latter by defending his authority
against internal revolts and external attacks. And this
domination had no other purpose than the economic exploitation of the vanquished
by the winner. No primitive state in all of world history has had
another origin (Oppenheimer: 1913). On the international scene
the concepts of power and power in the actions of States
can confirm this thesis. States have no friends, they only have
interests. They pursue a goal, forge ideals. The state can become
better than if one seeks to understand its nature and its sociological sense in
imposing on it a new term for these higher forms as
that social organization 7 .
In Haiti, however, one can quickly get an idea of the state at the
light of critical sociology of Oppenheimer. The Haitian state is in crisis,
he is ill “the disease of the state” or, a fortiori, does not exist.
Why ? Because since 1805, period when the Emperor
Jean-Jacques Dessalines wanted to establish a state of equality, equity and
well-being for all, we have never taken the time to conceptualize the state, to
create the state (since it is a social creation). If some thinkers (of
men of law for the most part) are bent on talking about the Haitian state as
if they really exist can they tell us the purpose pursued by this state?
What are the ideals that melt it? How do we perceive it?
The Haitian state since the
The Emperor's death has always been a ghost. It is a state of classes and
clans, a partisan state that does not care about the interest and well-being
collective. In addition to its economic, social and political
fundamentally a problem of conceptualization. We must conceptualize
the state, to give a meaning, a goal, an ideal to the state in order to reinvent the future
Today, the situation
has become more chaotic. The country is like a boat without rudder. All
seems to converge towards and for corruption. Corruption eats the state!
She alone directs. However, the people are crouching in the dirt and dying
in misery while more than 4 billion US dollars come
to burst into shine (Kot kob petro
caribe?). No hospitals nor
social housing, education is cheap, food a luxury,
the environment a disaster! The people no longer trust this
State it considers as its enemy: The State against the people!
The leaders speak, eat, negotiate and dance to the rhythm of the
corruption. State action sits on corruption and the future is emerging
only through corruption (whether in the political, social or
economic). The seine layer of the country (youth) is left to itself. the
highest in the state, we overcharge contracts, we invent phony projects
to steal and divert public money, we consume and drink coffee for
millions, even the promises are expensive in this country. Farmers give up
Earth ! The gang leaders lead the dance and play the game of
crazy about politics and economics! The people are suffering and despairing!
Our neighbor, the Dominican Republic is heading for a giant step on the road
progress. Cuba, Jamaica, Puerto Rico and
the small countries of the Antilles reinvent their future in this world
globalized while on our side, we prefer to wait for the solution of the
“White”, we beg here and there like stray dogs.
Alas! We have lost the ability to be ashamed, says Professor Hérold
Toussaint. But where are the insurgents,
the worthy girls and sons of Haiti, those who carry Haiti in their
heart and deep in their souls? Haitian people, indignant, give yourself
the freedom to live with dignity by revolt, defend your right to exist and
to hope, fight to build a Haitian state carrying ideals of
well-being and human values. You really deserve it ! Get out of this
silence if these thirsty shaved heads will end up all you devour.
